Legislative History

Recording of marriages on the county level was first required in New Jersey by "An Act Concerning Marriages," passed by the General Assembly on 4 March 1795 (see Acts of the Nineteenth General Assembly..., chap. 526, pp. 1004-7). This legislation required every justice of the peace and ordained minister to file, for each marriage he performed, a certificate with the clerk of the county in which the marriage took place. The returns were then to be copied by the county clerk into a book kept solely for that purpose.

This procedure remained the basic method of public recording of marriages in New Jersey until March 1848, when "An Act relating to the registry and returns of births, marriages, and deaths, in the State of New Jersey" was passed into law (P.L. 1848, pp. 155-8). The 1848 legislation required municipal clerks to submit annual returns of vital records to the Secretary of State. It also stipulated that marriage records were to include certain additional vital information, such as the age, occupation, parents' names, and residence of each party, and the place of marriage.

Despite the initiation of state-level recording, direct filing of marriage records with the county clerks continued for another thirty years. It was not until 5 April 1878 that further vital records legislation authorized marriage officiants to submit certificates to municipal clerks or assessors beginning on June 1st of that year (P.L. 1878, chap. 239, pp. 354-9). The municipal officers, in turn, were directed to file the records with the Secretary of State.


Content Note

This series contains both the original marriage returns submitted by Burlington County ministers and justices of the peace from 1795 to 1878 and the county clerk's recorded copies in Books A through E. Despite the 1878 change in the law, some couples chose to record their marriages with the county clerk after this date; consequently, Book E includes sporadic marriages dating from as late as 1920. The series also includes a complete typescript copy of Book A and a partial typescript copy of Book E (1847-1855 only). Each marriage book includes an index to the grooms’ names (both grooms and brides in Book B). Once the officiant is known, the original return can be located by consulting the Contents list below for the officiant's name.

It should be noted that 1795 marriage law required written consent of parents or guardians for marriages of minors (males under age 21 and females under age 18). A small number of consent certificates, therefore, may also be included with the returns.

The 1795 law also stipulated that the returns be filed within three months after the date of marriage if minors were involved, or within six months otherwise. This seems to have been frequently ignored, however, since returns listing marriages over periods of several years are common.

ACCESS NOTE: The marriage books are in very poor condition and researchers are requested to use the microfilm copy. Only the typescript of Book E is included on the film (ending in 1855); however, state marriage records are available beginning in May 1848.
